Consent from children and young people - Gillick Competency

There are many situations in which practitioners require consent for a particular decision or course of action, for example in relation to referrals or assessments. This is also the case in the health arena too .

Confusion and uncertainty can arise when children who are Gillick Competent give consent without their parents’ approval or knowledge. This is a complex practice area which can be difficult to navigate.

The Barnet Family Services Procedures Manual provides clear guidance around working with children below the age of 16 who may be Gillick competent; see chapter titled Capacity and Consent.

Please note, practitioners should always seek the advice and support of their manager in these situations.
